Terms and conditions.

The framework every order works within. The commercial specifics for your order are on your accepted quote, which forms the contract between us.

Who these terms apply to

These terms apply to everyone who orders from SixDessert, whether you are a hotel, a caterer, an event company, a business ordering for staff, or a private buyer ordering in bulk. They also apply to your use of this website.

SixDessert produces food to order from a kitchen in Kajang, Selangor. We do not sell single pieces, we do not hold stock for collection, and we do not operate a retail counter. Every order is quoted individually.

The contract

Your accepted quote, read together with these terms.

If they conflict

The accepted quote takes precedence, because it was written for your order.

Quotes and orders

A quote is a price, not a booking

Receiving a quote does not reserve production capacity. Your date and your production slot are reserved only when you accept the quote and we confirm the order in writing. Quotes are valid for the period stated on them.

Accepting an order

We confirm orders in writing. Until we do, no order exists, even if a quote has been issued. We may decline an order, and we would rather decline at this stage than accept work this kitchen cannot produce properly at your volume or by your date.

Specification

What we produce is what is written on your accepted quote: product, format, packing and quantity. Anything not written there is not part of the order. If you need something added or changed, it is agreed in writing before production begins.

Changes after confirmation

Quantity changes depend on remaining capacity in your slot. Date changes depend on whether another slot exists. A change of packing format is treated as a new quote. The ordering process

Pricing, payment and cancellation

The figures that apply to you are the ones on your accepted quote. This section explains how they work rather than what they are.

Pricing

Prices are quoted per order because they depend on product, quantity, packing format and delivery. A price quoted for one order does not carry over to the next unless we say so in writing. Any delivery charge is stated on the quote.

Payment terms

Payment terms, including any deposit and when the balance falls due, are stated on your quote. Where terms are offered to trade buyers, they are agreed before the first order rather than assumed.

Cancellation

Before production begins, cancellation follows the terms on your quote. Once production has begun, ingredients and a production slot are committed to your order and cancellation is treated differently. The terms are on your quote.

Late payment

Where an invoice is not settled on the agreed terms, we may hold further production until it is. We will tell you before that happens rather than let a date pass quietly.

Delivery, food safety and your responsibilities

Delivery arrangements, storage conditions and shelf life for your batch are set out in your quote and in our delivery and refund policy. Once an order has been received and signed for, responsibility for storing, handling and serving it passes to you.

Ingredient and allergen information is provided with your order. If anyone in your service has a specific dietary or allergen requirement, raise it before you confirm. We cannot be responsible for product stored outside the stated conditions, repacked, re-portioned or re-branded after delivery. Delivery and refund policy

Private label, brands and intellectual property

What you bring stays yours

A recipe, specification, artwork or brand you provide remains yours. We produce to it for your orders and do not use it elsewhere.

What we develop

Where we develop a product specifically for you, ownership and any exclusivity are agreed in writing before the first production run rather than assumed by either side afterwards. Private label and OEM

Our material

Our own recipes, product names, photographs and the content of this website remain ours. Please do not reproduce them without asking.

Reproducing other brands

We will not produce a copy of a product belonging to another brand, and you confirm that anything you ask us to make does not infringe someone else rights.

Liability, disruption and changes

Our liability

Where we are at fault, our responsibility is to put the order right by replacement or refund of the affected items, as set out in the delivery and refund policy. Nothing in these terms limits liability that cannot be limited by law, and nothing limits your statutory rights under Malaysian consumer protection law.

Events beyond control

Neither side is responsible for failing to perform because of something genuinely outside its control, such as utility failure, flooding, a public health order or a supply interruption. If that happens we will tell you immediately, because on an event date early news is worth more than an apology afterwards.

We keep this site accurate, but product descriptions and guidance here are general. The specification that governs your order is the one on your quote.

Changes to these terms

We may update these terms. The version that applies to your order is the one in effect when we confirmed it. Privacy policy
